It has come to our attention that assertions are being aired on the Internet about the veracity of our earlier article, "Who Can You Believe?"  These comments appear to centre on four areas:

1.    There is uncertainty about the BC levies applicable to RBCs that have not cancelled their existing Management Agreements
2.    Proxies should not be allowed at AGMs or EGMs
3.    Mr V Vine sits on the PBC Executive Committee without proper authority
4.    The HIR News website cannot be considered to be "the only official website for HIR"


The real facts are as follows:

1.    Owners will be charged levies in accordance with the prevailing Management Agreement for their RBC and the requirements of the legislation.  The new Agreements result in lower levies than the prior Agreements and RBCs operating under the old Agreements will pay more than those operating under the new Agreements.  The PBC Executive Committee will facilitate a move from the old to the new Agreement for any RBC that wishes to make the transition but has not yet done so.

2.    Proxies and their use are embodied in the legislation that governs HIR and are an integral part of the governance system.  Without debating the merits of Proxies and their use - and there are many - it is not legally tenable to eliminate them.

3.    An owner in HIR raised this question some time ago and the PBC sought legal advice.  The Solicitor's advice was that Mr Vine was properly nominated and elected to the PBC Executive Committee.  The PBC has considered that advice carefully and accepts it without reservation.

4.    The HIR News website does NOT claim to be "the only official website for HIR".  It DOES claim, and rightly so, to be the only official website for information about the PBC and the PTBC
