MANAGEMENT OF COMMON PROPERTIES - THE REAL SITUATION
An article floating around on an unofficial website, purporting to explain the situation concerning the management of common properties in our Resort has been brought to our notice as a misrepresentation of the real situation. We thought therefore, that we would set the record straight once again.
Obviously the authors of the article are still living in the past and cannot comprehend or do not want to recognise and accept the improvements achieved from recent negotiations for new Management and Administration Agreements.
They clearly demonstrate that they do not comprehend the real facts and are guided/advised, or should we say misguided and misadvised, by those who are determined to misinform you and disrupt all the improvements achieved in the new agreements. Their misleading articles also continue to adversely impact on the value and sales of our properties.
One of the prime reasons for all the negotiations which have taken place over the last 2 years has been to eliminate the flaws in past agreements, including common property management issues.
The old, and we emphasise, the old Management Agreements were flawed and only mentioned common property, while in essence, although not stated in the Agreement, the fee charged related also to the management of the PBC Secondary Thoroughfare assets and infrastructure, which includes roads and roundabouts, street and other lighting, waterways and moorings, water distribution networks, sewerage system, gardens, parks and landscaping, fencing, the security surveillance system and the security and vehicles. The fee also covers any requirements in regard to the PBC Security staff, the ARA and all the other Sub-Committees.
The new Management Agreement between the PBC and CMS is solely related to the management of the PBC Secondary Thoroughfare assets and infrastructure, and the financial responsibility has now been included as part of the PBC budget (newly approved at the PBC EGM in November).
This is separate to the local common property matters in Bodies Corporate. It has also clarified the management and financial responsibility for the PBC common assets which are owned by all lot owners.
Responsibility for the management of the common property in each Residential Body Corporate has now been included as part of the new Residential Body Corporate Agreement (RBCA) and is subject to finalisation between each Body Corporate and CMS separately. Some Bodies Corporate also have separate expenditure for any direct costs related to their common property such as lawn mowing, gardening and tree trimming. In the majority of cases there is no management fee or additional expenditure incurred in RBC budgets. This has strengthened the independence of local Bodies Corporate in respect to their own residential precincts.
The PBC and the majority of lot owners in the Residential Bodies Corporate that have signed the new Agreements, LIVE IN THE PRESENT AND BENEFIT FROM ALL THE CHANGES ACHIEVED.
The members of Marina Houses have just voted to adopt the new agreements and will now realise almost $14,000 pa in savings in their budget which will be shared by them all, just like the members of the greater majority of other local Bodies Corporate who will soon receive similar savings in their levy invoices.
Owners in Stillwater voted to terminate their former Management Agreement and sign the new Agreement to achieve savings of over $55,000 pa, and to exercise their prerogative to manage their own common property.
Lakes East owners at a recent EGM, influenced by supporters of the "anti - CMS group", voted against terminating their current Management and Administration Agreements and accepting the new Agreements offered by CMS, and so they continue to pay far more than their neighbours in Lakes Views and Lakes Waters, who voted to terminate the former Management and Administration Agreements and sign the new agreements.
